Dr. Muhammad Buwule Kasasa: A Legacy of Resilience and Justice in the Mutungo Land Dispute

By John Kusolo

The late Dr. Muhammad Buwule Kasasa's life story is a testament to unwavering resilience and the pursuit of justice. For nearly three decades, Dr. Kasasa, a prominent businessman and a revered elder within the Buganda community, fought a protracted legal battle to assert his rightful ownership of the contested Mutungo Hill land, an ordeal that etched his name in the annals of Uganda's legal history.

A Man of Patience and Tenacity

Dr. Kasasa's journey to justice was long and fraught with challenges. His struggle over the Mutungo Hill land, which spans eight zones, symbolized his relentless quest for truth and fairness. Despite the financial and emotional toll, he remained steadfast, investing considerable resources in legal fees and enduring the exhaustive court processes. His determination was further tested by the high stakes of his battle, which involved direct opposition to his own cultural and traditional leader, Kabaka Ronald Muwenda Mutebi II of Buganda.

A Stalwart Supporter of the Kabaka

Contrary to accusations of disrespect towards the Kabaka, Dr. Kasasa's actions reflected his deep reverence for the Buganda monarchy. One notable instance of his loyalty was when he hosted the young bridesmaids from Kabaka Mutebi's wedding to Lady Sylvia Nagginda Ssebuggwaawo at his hotel in Namirembe. This gesture underscored his respect and support for the royal family, even as he pursued his legal battle.

The Legal Battle for Mutungo Hill

Dr. Kasasa's dispute over the Mutungo Hill land began with the family of the late King Edward Muteesa II. The land, initially part of the royal estate, was legally transferred to Dr. Kasasa. However, the royal family continued to demand compensation from the Ugandan government for the property, complicating the ownership issue. Dr. Kasasa’s legal odyssey saw numerous court appearances and substantial financial expenditure, all in a bid to establish his rightful claim.

In a landmark ruling, the Court of Appeal panel, consisting of three justices, ultimately declared Dr. Kasasa the legitimate owner of the Mutungo Hill and Kitintale land. This decision brought a sense of closure to a prolonged saga, affirming Dr. Kasasa's persistence and commitment to justice.

Legacy and Impact

Dr. Kasasa’s victory was not merely a personal triumph but also a significant precedent in Ugandan property law. It highlighted the importance of vigilance and perseverance in the pursuit of justice, serving as an inspiration to others facing similar challenges. His case underscored that justice, though often delayed, can be achieved through steadfast determination and faith in the legal system.

Dr. Kasasa's death marks the end of an era, but his legacy of resilience and integrity endures. He leaves behind a powerful message: that true justice requires courage, patience, and an unwavering commitment to one's principles. His life story remains a beacon of hope for those who continue to seek justice in the face of adversity.
